Grant of License
Provided strictly in accordance with this EULA, ippo technologies ("Licensor") grants you a revocable, non-exclusive, non-transferable, and limited license to install and use the Application on a specified number of Mac or Windows computers for your personal or internal business purposes.
Acquisition and Activation
Paddle One-Time Purchase
Access to the Application is provided through a one-time purchase via Paddle, our authorized payment processor. Your license is tied to your CapyBreaks account and is non-transferable. You may not share, distribute, or sell your license access to others.
Agreement to Terms
By completing a purchase and utilizing the Application, you confirm that you have reviewed, comprehended, and agreed to adhere to the stipulations of this EULA.
Intellectual Property Rights
ippo technologies remains the sole owner of all titles, rights, and interests regarding the Application, including all associated intellectual property. This EULA grants you the right to use the Application but does not transfer any ownership rights to you beyond the limited license described herein.
Software Updates
Updates to the Application are included with your one-time purchase. These updates may be deployed automatically or require manual installation, depending on the platform.
Restrictions on Use
Device Limits
Your license authorizes use on a reasonable number of personal devices. You may install and use the Application on your Mac or Windows computers for your personal or internal business use. Sharing your account credentials with others is not permitted.
Prohibited Conduct
- You may not reverse engineer, decompile, or disassemble the Application, except where such restriction is expressly prohibited by law.
- You may not modify, adapt, or create derivative works based on the Application.
- You may not remove, alter, or hide any proprietary notices, labels, or marks on the Application.
- You may not use the Application for any illegal or unauthorized purpose.
- You may not sublicense, rent, lease, or transfer the Application or your license to any third party.
Disclaimer of Warranties
THE APPLICATION IS PROVIDED "AS IS", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, ippo technologies DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability
UNDER NO CIRCUMSTANCES SHALL ippo technologies BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE APPLICATION, EVEN IF ippo technologies HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIABILITY LIMITATIONS, SO THIS MAY NOT APPLY TO YOU.
Term and Termination
This EULA remains effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Application and destroy all copies of the Application in your possession.
Governing Law
This EULA is governed by the laws of the United States, excluding its conflict of law rules. You specifically agree that exclusive jurisdiction for any claim or dispute with ippo technologies relating in any way to your use of the Application resides in the courts of the United States.
Entire Agreement
This EULA constitutes the entire agreement between you and ippo technologies regarding the Application and supersedes all prior agreements and understandings, whether written or oral, concerning the subject matter of this EULA.
